CHARLOTTESVILLE, VA (CVILLE RIGHT NOW) – In an 11-page ruling released on Friday, August 22, Charlottesville Circuit Court Judge Claude V. Worrell II granted the city of Charlottesville’s motion to reconsider the default judgement in White v Charlottesville.
The plaintiffs are a group of Charlottesville homeowners who feel they will be harmed by the additional density in the city’s new zoning ordinance. A major claim in the suit is that “City Council failed to conduct reasonable or adequate studies” of the zoning code’s impact.
At the heart of the case is whether a transportation study is required to implement a zoning ordinance in a city the size of Charlottesville. The city’s interpretation of state law is that is does not. Worrell’s ruling will let the city once again present the merits of its case.
